勞(lao)(lao)動(dong)合同(tong)(tong)是勞(lao)(lao)動(dong)者與用工(gong)(gong)單位(wei)之(zhi)間(jian)確(que)立勞(lao)(lao)動(dong)關系,明確(que)雙(shuang)方權利和義務的協議。勞(lao)(lao)動(dong)合同(tong)(tong)的概念及結(jie)構(gou):(1)勞(lao)(lao)動(dong)合同(tong)(tong)期限和試用期限;(2)工(gong)(gong)作內容和工(gong)(gong)作時(shi)間(jian);(3)勞(lao)(lao)動(dong)報酬(chou)和保險、福(fu)利待遇;(4)生(sheng)產條(tiao)件或工(gong)(gong)作條(tiao)件;(5)勞(lao)(lao)動(dong)紀律(lv)和政治待遇;(6)勞(lao)(lao)動(dong)合同(tong)(tong)的變更和解除;(7)違約(yue)責任;(8)當事人約(yue)定的其他事項
勞(lao)(lao)動(dong)(dong)合同(tong)應(ying)當具備以下條(tiao)(tiao)款(kuan):(一)用人單(dan)位(wei)的(de)名稱、住(zhu)所和(he)(he)(he)法(fa)定代(dai)表人或(huo)者主要負責人;(二)勞(lao)(lao)動(dong)(dong)者的(de)姓(xing)名、住(zhu)址和(he)(he)(he)居民身(shen)份證(zheng)或(huo)者其(qi)他(ta)有效身(shen)份證(zheng)件(jian)號碼;(三)勞(lao)(lao)動(dong)(dong)合同(tong)期限;(四)工(gong)作內容和(he)(he)(he)工(gong)作地(di)點(dian);(五)工(gong)作時(shi)間和(he)(he)(he)休息休假;(六)勞(lao)(lao)動(dong)(dong)報酬;(七(qi))社(she)會保險;(八)勞(lao)(lao)動(dong)(dong)保護、勞(lao)(lao)動(dong)(dong)條(tiao)(tiao)件(jian)和(he)(he)(he)職業危(wei)害防護;(九)法(fa)律、法(fa)規規定應(ying)當納(na)入勞(lao)(lao)動(dong)(dong)合同(tong)的(de)其(qi)他(ta)事(shi)(shi)項(xiang)。勞(lao)(lao)動(dong)(dong)合同(tong)除前款(kuan)規定的(de)必(bi)備條(tiao)(tiao)款(kuan)外,用人單(dan)位(wei)與勞(lao)(lao)動(dong)(dong)者可以約定試用期、培訓(xun)、保守秘密、補充保險和(he)(he)(he)福利待遇(yu)等其(qi)他(ta)事(shi)(shi)項(xiang)。
根據《勞(lao)(lao)動(dong)(dong)法》規定(ding)(ding)(ding)(ding)(ding),用人單位與(yu)勞(lao)(lao)動(dong)(dong)者簽訂的勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)期限(xian)(xian)可以分為三(san)類:(1)有(you)固定(ding)(ding)(ding)(ding)(ding)期限(xian)(xian),即(ji)在(zai)合(he)(he)同(tong)(tong)(tong)中明確約定(ding)(ding)(ding)(ding)(ding)效力期間,期限(xian)(xian)可長可短,長到幾(ji)年、十幾(ji)年,短到一(yi)(yi)(yi)年或者幾(ji)個(ge)月(yue)。(2)無固定(ding)(ding)(ding)(ding)(ding)期限(xian)(xian),即(ji)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)中只約定(ding)(ding)(ding)(ding)(ding)了起始日期,沒有(you)約定(ding)(ding)(ding)(ding)(ding)具體(ti)終(zhong)止(zhi)日期。無固定(ding)(ding)(ding)(ding)(ding)期限(xian)(xian)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)可以依法約定(ding)(ding)(ding)(ding)(ding)終(zhong)止(zhi)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)條件(jian)(jian)(jian),在(zai)履(lv)行中只要不(bu)出現約定(ding)(ding)(ding)(ding)(ding)的終(zhong)止(zhi)條件(jian)(jian)(jian)或法律規定(ding)(ding)(ding)(ding)(ding)的解除條件(jian)(jian)(jian),一(yi)(yi)(yi)般不(bu)能解除或終(zhong)止(zhi),勞(lao)(lao)動(dong)(dong)關系(xi)可以一(yi)(yi)(yi)直存續到勞(lao)(lao)動(dong)(dong)者退休為止(zhi)。(3)以完(wan)成一(yi)(yi)(yi)定(ding)(ding)(ding)(ding)(ding)的工(gong)(gong)作為期限(xian)(xian),即(ji)以完(wan)成某項(xiang)工(gong)(gong)作或者某項(xiang)工(gong)(gong)程(cheng)為有(you)效期限(xian)(xian),該項(xiang)工(gong)(gong)作或者工(gong)(gong)程(cheng)一(yi)(yi)(yi)經完(wan)成,勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)即(ji)終(zhong)止(zhi)。 簽訂勞(lao)(lao)動合(he)(he)同可以(yi)不(bu)(bu)約定試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi),也(ye)可以(yi)約定試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi),但試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)最(zui)長不(bu)(bu)得(de)超(chao)(chao)過6個月。勞(lao)(lao)動合(he)(he)同期(qi)(qi)(qi)限(xian)(xian)在6個月以(yi)下的,試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)不(bu)(bu)得(de)超(chao)(chao)過15日;勞(lao)(lao)動合(he)(he)同期(qi)(qi)(qi)限(xian)(xian)在6個月以(yi)上(shang)1年以(yi)下的,試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)不(bu)(bu)得(de)超(chao)(chao)過30日;勞(lao)(lao)動合(he)(he)同期(qi)(qi)(qi)限(xian)(xian)在1年以(yi)上(shang)2年以(yi)下的,試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)不(bu)(bu)得(de)超(chao)(chao)過60日。試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)包括在勞(lao)(lao)動合(he)(he)同期(qi)(qi)(qi)限(xian)(xian)中。非全日制勞(lao)(lao)動合(he)(he)同,不(bu)(bu)得(de)約定試(shi)(shi)用(yong)(yong)(yong)期(qi)(qi)(qi)。
